HC finds contradiction between reports on Hazari’s release

The High Court on Wednesday found contradictory the jail authorities statement and the report published on a Bangla daily on the release of arms case convict Awami League lawmaker Nizam Uddin Hazari from the jail.
The inspector general of prisons and the jailer of the Chittagong Central Jail in a report submitted to the court said that convict Nizam Hazari was released on bail from the jail on June 1, 2006 after he had obtained one-year bail from the High Court on May 27, 2006 in the appeal filed in 2006 against his conviction.
The jail authorities also attached the copy of Nizami’s bail order which stated Nizam was sentenced to seven-year imprisonment for keeping a knife.
Vernacular daily Prothom Alo referring to Chittagong Central Jail’s convicts’ registry said that Nizam Hazari was released on December 1, 2005 after completion of his sentence.  The registry showed that Nizam Hazari was released after deducting one year, six months and 17 days from his 10-year sentence.
In the wake of the confusion, the bench of Justice Mirza Hussain Haider and Justice Muhammad Khurshid Alam Sarkar directed the IGP (prisons), and the jailer to submit explanation over the newspaper report by August 31.
The bench also directed the Supreme Court registrar to submit to the court the documents on his two appeals filed in 2000 and 2006 with the High court against the conviction awarded by the trial court in August 2000 for keeping illegal arms.
The matter was appeared in the High Court after it on June 8 directed the jail authorities and the editor and publisher of the daily to submit their reports about Nizam Hazari’s release documents.
The High Court had directed the Election Commission and convict Nizam Uddin Hazari to explain why his parliamentary constituency would not be declared vacant after hearing a writ petition filed by Feni unit Juba League former joint convener Shakwat Hossain Bhuiyan challenging the legality of convict Nizam continuing as an MP.
