The Appellate Division on Monday directed Bangladesh Nationalist Party acting secretary general Mirza Fakhrul Islam Alamgir to surrender to the lower court in 15 days in three cases of vandalism.
The five-member bench headed by chief justice SK Sinha passed the order disposing of Fakhrul’s petition for extension of his bail the High Court had granted for three months in the cases on November 24, 2015.
The apex court said that his lawyers gave Fakhrul ‘ill advice’ and the petition was not timely.
Fakhrul got the copy of the High Court order on December 21, 2015 but he appealed for extension of the bail on February 18, 2016, six days before its expiry, the court observed.
What Fakhrul did after he got the copy of the High Court order granting the bail, the court asked his lawyer Zainul Abedin.
In the appeal, Fakhrul stated that the High Court in the verdict committed a serious mistake in the granting interim bail instead of regular bail.
Zainul submitted newspaper clippings of Fakhrul’s rejoinder that stated that Fakhrul made no statement against the judiciary on February 7.
On February 18, the Appellate Division asked Fakhrul to explain his remarks he reportedly made in Sylhet city on February 7 alleging that the government was indulging in fascist activities and controlling the judiciary.
On Monday, the court said that every citizen should respect the judiciary and politicians and lawyers should make no derogatory remarks against the judiciary.
Judiciary is now independent and it is not part of the government, but an organ of the state, the court said.
